Terms of Service

By using PanKaro, you agree to comply with all the terms below. These terms are strict and binding.

1. Acceptance: By accessing or using the Service you accept and agree to be bound by these Terms.
2. Definitions: "Service" means PanKaro website and related services; "User" means any person using the Service.
3. Eligibility: You must be at least 18 years old and legally capable to enter contracts in India.
4. Account Responsibility: You are responsible for maintaining the confidentiality of account credentials and for all activity under your account.
5. Accurate Information: You must provide true, accurate, current and complete information when using the Service.
6. Document Authenticity: Users must submit only genuine, government-issued documents; forged or tampered documents are strictly prohibited.
7. Use Restrictions: You agree not to misuse the Service, post illegal content, or attempt unauthorized access to the platform.
8. Service Scope: PanKaro is a facilitator that assists with PAN application submissions; final approval is decided by the issuing government authority.
9. No Guarantee of Outcome: We do not guarantee approval, processing times, or results from government authorities.
10. Payment Terms: All fees are due as specified; failure to pay may result in suspension of services.
11. No Refunds: Unless explicitly stated otherwise, payments are non-refundable once the application process has started.
12. Taxes & Duties: Users are responsible for any applicable taxes, duties or charges imposed by government authorities.
13. Limitation of Liability: To the maximum extent permitted by law, PanKaro and its affiliates will not be liable for indirect, incidental, consequential, special, punitive or exemplary damages.
14. Monetary Cap: Our aggregate liability for any claim arising out of or relating to these Terms will not exceed the total fees paid by you to PanKaro in the six (6) months preceding the claim.
15. Exclusion: We are not liable for delays or failures caused by government systems or third-party services outside our control.
16. Indemnification: You agree to indemnify, defend and hold harmless PanKaro, its officers, directors, employees and agents from any claim, loss or liability arising from your breach of these Terms or your misuse of the Service.
17. Third-Party Services: The Service may contain links to third-party websites; we are not responsible for their content, policies, or actions.
18. Intellectual Property: All content, trademarks and logos on the Service are the property of PanKaro or its licensors and are protected by law.
19. License to Use Content: We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.
20. Prohibited Content: You must not upload content that is fraudulent, defamatory, obscene, infringing or otherwise unlawful.
21. Account Termination: We reserve the right to suspend or terminate accounts for breach of these Terms or suspected illegal activity without prior notice.
22. Suspension Effects: Suspension or termination does not relieve you of unpaid fees or other outstanding obligations.
23. Security Measures: We implement commercially reasonable security measures, but cannot guarantee absolute security of data transmitted or stored.
24. Data Accuracy: You acknowledge that we rely on data you provide; we are not responsible for errors that result from incorrect information provided by you.
25. Privacy: Use of personal data is governed by our Privacy Policy; by using the Service you consent to our data practices.
26. Record Keeping: You must retain originals of all submitted documents and records as required by law; PanKaro may retain copies as permitted by law and our policies.
27. Force Majeure: We are not liable for failure or delay caused by events beyond our reasonable control, including natural disasters, strikes, government actions, or interruption of internet services.
28. Modifications to Service: We may modify, suspend or discontinue the Service (or any part) at any time with or without notice.
29. Amendments to Terms: We may update these Terms; continued use after changes constitutes acceptance. We will post the updated Terms and the effective date.
30. Severability: If any provision is found invalid or unenforceable, the remainder will remain in effect to the fullest extent permitted by law.
31. Entire Agreement: These Terms, together with our Privacy Policy and any other referenced policies, constitute the entire agreement between you and PanKaro.
32. Governing Law: These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts located in West Bengal, India.
33. Dispute Resolution: Parties will attempt in good faith to resolve disputes amicably before commencing formal legal action.
34. Limitation Period: You must bring any claim related to the Service within one (1) year from the date the cause of action arose, to the extent permitted by law.
35. No Waiver: Failure to enforce any right under these Terms does not waive that right.
36. Assignment: PanKaro may assign its rights and obligations; users may not assign without our prior written consent.
37. Notices: We may send notices by email or through the Service; notices are effective when sent.
38. Electronic Communications: You consent to receive electronic communications and agree that they satisfy any legal requirement for written notice.
39. Compliance with Laws: You will comply with all applicable laws, rules and regulations when using the Service.
40. Export Controls: You will not use the Service in a manner that violates export or import laws.
41. Account Termination Effects: Upon termination, your right to use the Service ceases and we may delete or retain data as permitted by law.
42. Refunds & Chargebacks: Repeated chargebacks or fraudulent payment claims may result in permanent account termination and pursuit of recovery.
43. Fees Changes: We may change fees or introduce new charges; changes will be posted in advance when practicable.
44. Promotions: Any promotional offers are subject to separate terms and may be withdrawn at any time.
45. Feedback: If you provide feedback, you grant PanKaro a perpetual, royalty-free, worldwide license to use it.
46. Service Availability: We do not guarantee uninterrupted access; scheduled or emergency maintenance may occur.
47. Warranty Disclaimer: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
48. No Professional Advice: Information on the Service is not legal, tax, or professional advice; consult qualified professionals for such advice.
49. Age Restriction: Minors must obtain parental consent before using the Service; minors' accounts may be terminated at our discretion.
50. Acceptable Use: You must not use the Service to harass, defraud, infringe IP rights, or post harmful content.
51. Limit on Claims: Certain statutory rights may not be excluded or limited; where law mandates, such rights remain unaffected.
52. Cooperation with Authorities: We may disclose information to law enforcement or regulators as required by law.
53. Account Recovery: We may require identity verification to recover or restore accounts suspected of compromise.
54. Backups: You are responsible for keeping backups of your own records; PanKaro is not obligated to maintain backups for users.
55. Beta Services: Beta or trial features are provided "as is" and may have different terms or no refunds.
56. Third-Party Tools: If you integrate third-party tools, you do so at your own risk and subject to their terms.

61. Language: These Terms are drafted in English. If translated, the English version prevails in case of conflict.
